When changing business conditions force companies to downsize, older and higher-paid employees are often the most affected. Complaints to the Equal Employment Opportunity Commission rose 41 percent between 1999, when the economy was thriving, and 2002, after the dot-com crash. Ohio State University researchers found that businesses often did not follow objective criteria for layoffs. Belt-tightening measures that were supposed to be age-neutral were often skewed toward older employees. But the OSU team also found ageism to be an equal opportunity offense: professional, managerial, skilled, semi-skilled and unskilled workers all filed age discrimination complaints.
Attorneys Shirley J. Christian and Carmen V. Codjoe of Harrington, Hoppe & Mitchell, Ltd. will discuss age discrimination and some best practices for employers.
