Northeast Ohio employers often have employees who live or work in neighboring Pennsylvania, West Virginia or other states throughout the region. As a state-regulated function, workers’ compensation interstate jurisdiction issues are inherently complex.
An employee may attempt to pursue a claim in the state of residence, the state in which work was performed, the state of injury and the state(s) in which workers’ compensation coverage was obtained by the employer. It is up to a state's regulatory authority to either take jurisdiction over a claim or deny it.
